Terms of Service

1. Acceptance of Terms

By creating an account or otherwise using MemeRank (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use MemeRank. By registering, you represent and warrant that you meet this requirement. The Service contains content that may be sexually explicit, graphic, or otherwise unsuitable for minors, gated behind NSFW-labeled sections.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Your email address is your permanent account identifier and cannot be changed after registration. You must provide accurate information and keep it up to date.

4. User Content

You retain ownership of content you upload ("User Content"). By posting User Content, you grant MemeRank a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it as necessary to operate and promote the Service. You represent that you own or have the necessary rights to post your User Content and that it does not infringe any third party's rights.

5. Prohibited Content and Conduct

You may not upload, post, or transmit content that:

• Depicts or promotes child sexual abuse material (CSAM) — accounts responsible for this will be permanently banned and reported to the National Center for Missing & Exploited Children (NCMEC) or equivalent authorities.
• Infringes intellectual property rights of others.
• Is unlawful, defamatory, harassing, or threatens violence.
• Is NSFW/sexually explicit but not tagged/posted in an NSFW-gated section.
• Contains malware or attempts to compromise the Service's security.
• Impersonates any person or entity.
• Constitutes spam, or manipulates voting/ranking systems (vote manipulation, bot activity).

6. Moderation and Enforcement

We may remove content, suspend, or terminate accounts that violate these Terms at our discretion, with or without notice. Automated systems (perceptual-hash matching, an NSFW classifier, and community reporting) assist moderation but do not replace human review for enforcement decisions with material consequences.

7. Copyright / DMCA

We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act. See our DMCA takedown form to submit a notice. Repeat infringers' accounts will be terminated.

8. Subscriptions and Billing

Paid subscription tiers (Plus, Pro) are billed via Stripe on a recurring basis until canceled. You can manage or cancel your subscription at any time through the billing portal. Fees are non-refundable except where required by law.

9. Third-Party Services

The Service relies on third-party providers including Stripe (payments), Railway (hosting/storage), Cloudflare (security/CAPTCHA), Resend (email), and advertising networks. Your use of the Service is also subject to those providers' terms where applicable.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee the accuracy, completeness, or reliability of any User Content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMERANK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time by contacting us.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
